You’ve made a fair offer. The numbers are solid. And yet — the case drags on. Why?
This webinar challenges the traditional, transactional approach to negotiation that dominates civil litigation and explores why money alone often isn’t enough to resolve disputes. We’ll examine The Money Myth — the belief that legal cases are resolved purely through financial terms — and offer a fresh perspective grounded in integrative bargaining and modern mediation strategies.
Designed for attorneys who represent defendants in civil litigation, this session will help you recognize when purely evaluative mediation is falling short, and how incorporating facilitative or transformative methods can lead to more durable, client-aligned outcomes — without compromising your legal strategy.
You’ll learn: 1. Why parties resist settlement, even when offers are reasonable 2. How transactional negotiation limits your leverage — and results 3. When and how to apply mediation styles that move cases forward Presenter Bio Brenda Waugh, Esq. is an attorney and mediator with over thirty years of experience, licensed to practice in West Virginia, Virginia, and the District of Columbia.
