Program Details:

  • Session 1: "Drafting Dispositive Provisions" presented by Farhad Aghdami, Esq. of Williams Mullen, Richmond, VA. This presentation reviews efficient ways of drafting dispositive provisions in wills and trusts, including per stirpes and per capita language, anti-lapse statutes, survivorship requirements, income and principal distributions, ascertainable standards, 5 x 5 powers, and powers of appointment. Tax implications are covered, and opportunities associated with decanting and unitrust conversions are explored.

  • Session 2: "Major Planning for Minors" presented by Christopher J. Winton, Esq. of Ray, Winton & Kelley, PLLC. This presentation analyzes the legal issues in making gifts or bequests to minors including guardianship, Uniform Transfers to Minors Act accounts, and trusts for minors.

  • Session 3: "Intersection of Divorce Law and Estate Planning" presented by Mark W. Kelley, Esq. of Ray, Winton & Kelley, PLLC. Clients die and clients get divorced. Divorce can have unintended consequences on estate planning documents, and estate planning documents can have unintended consequences in a divorce. This presentation provides estate planning practitioners with guidance on these domestic law issues, especially for those clients who are established in their careers and marry later in life. Prenuptial agreements, family court jurisdiction, and beneficiary forms are discussed.

  • Session 4: "Handling the Business in the Estate" presented by J.E. White, Esq. of Jackson Kelly PLLC. Business owners die and their interests need to be administered in the estate. This presentation focuses on how to handle business-related issues in an estate, such as the fiduciary running the business, the selling of the business or its assets, valuation of closely-held business interests, dispositions or transfers of the business interest, and applying shareholder and operating agreements.

  • Session 5: "Attorney Succession Planning" presented by E. William Harvit, Esq. of Hartley Law Group, PLLC.
