  • Session 1: "Guardian Angels: Wrongful Death Actions, Estate Planning, and Guardian Appointments" with Prof. Noel P. Brock, JD, CPA of Eastern Michigan University

    State wrongful death statutes not only create a right to sue, but also dictate a class of individuals who may receive the wrongful death proceeds. These laws override marital property division as well as intestate succession and probate laws. When these statutes are understood, there are steps an estate planning attorney can take to help the client direct to whom any wrongful death recovery will be distributed.

  • Session 2: "Lights, Camera, Conservatorship: Avoiding Hollywood's New Trend in West Virginia" with Anna M. Price, Esq. of Jenkins Fenstermaker, PLLC

    Real-life dramas involving celebrity guardianship and conservatorship cases have been making headlines. Using examples from Hollywood, we will explore how these situations may be different or potentially avoided in West Virginia. We will cover the benefits of proper planning with powers of attorney versus default court proceedings and also include practical tips for guardianship and conservatorship actions in West Virginia when they are needed.

  • Session 3: "Planning Before the Storm: Tips and Tools for Asset Protection" with J.E. White, Esq. of Jackson Kelly PLLC 

    We live in a litigious society, and clients will often insist upon and need planning to protect and preserve assets for themselves and their families. This presentation will cover some of the best techniques for asset protection in West Virginia, including using trusts, making gifts, forms of title ownership, and qualified plan protections.

  • Session 5: "Joint Bank Accounts: Good, Bad and Litigation" with John F. Hussell, Esq. of Wooton, Davis, Hussell & Johnson, PLLC

    Known as the “poor man’s will,” joint bank accounts with survivorship are commonly held by clients and frequently create family disputes concerning ownership after the depositor’s death. This presentation explores the complex statutory and case law doctrines of joint accounts, with suggestions to practitioners on how to avoid problems or how to handle litigation to make a probate claim.
