Just as in life when circumstances change, trusts sometimes need to be changed.  Since West Virginia’s adoption of the Uniform Trust Code in 2011, the use of Nonjudicial Settlement Agreements to modify irrevocable trusts has exploded.  Although not a panacea, Nonjudicial Settlement Agreements are effective tools for the practitioner’s toolbox when a trust needs a fix.
